PENERAPAN RESTORATIVE JUSTICE DALAM PROSES PENUNTUTAN PERKARA TINDAK PIDANA PENCURIAN

Abstrak

Penelitian ini bertujuan untuk menganalisis penerapan Restorative Justice dalam proses penuntutan perkara tindak pidana pencurian. Restorative Justice merupakan pendekatan yang menekankan pada pemulihan kerugian korban, rekonsiliasi antara pelaku dan korban, serta keterlibatan masyarakat dalam proses penyelesaian perkara. Penelitian ini mengkaji peran Jaksa Penuntut Umum dalam penerapan Peraturan Jaksa Agung Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Restorative Justice. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis. Hasil penelitian menunjukkan bahwa penerapan Restorative Justice dapat mengurangi beban lembaga pemasyarakatan dan memberikan keadilan yang lebih berimbang bagi korban dan pelaku. Namun, pelaksanaannya masih menghadapi berbagai tantangan, termasuk batasan nilai kerugian korban yang dapat diterima dan kurangnya pemahaman serta dukungan dari aparat penegak hukum dan masyarakat. Penelitian ini merekomendasikan peningkatan sosialisasi dan pelatihan bagi aparat penegak hukum serta penyesuaian regulasi untuk mendukung penerapan Restorative Justice yang lebih efektif.

This study aims to analyze the application of Restorative Justice in the prosecution process of theft criminal cases. Restorative Justice is an approach that emphasizes the recovery of victims' losses, reconciliation between perpetrators and victims, and community involvement in the case resolution process. This research examines the role of the Public Prosecutor in the implementation of Attorney General Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. The research method used is normative juridical with an analytical descriptive approach. The results showed that the application of Restorative Justice can reduce the burden on correctional institutions and provide more balanced justice for victims and perpetrators. However, its implementation still faces various challenges, including limits on the acceptable value of victim losses and a lack of understanding and support from law enforcement officials and the community. This study recommends increased socialization and training for law enforcement officials as well as regulatory adjustments to support more effective implementation of Restorative Justice.
