ANALISIS YURIDIS PENANGGULANGAN PERBUATAN EIGENRICHTING BAGI PELAKU PENCURIAN

Abstrak

Eigenrichting is an expression used to refer to a situation where an individual or a group of people
actively apply the law independently without following legal procedures. The Barelang City Police
Department (Polresta Barelang) always strives to enhance the professionalism and accountability of
law enforcement, both through education and improving welfare, so that they can carry out their
functions and authorities in accordance with the legal regulations. This research aims to explore the
legal regulations regarding the prevention of eigenrichting for theft offenders and to identify the
obstacles in preventing eigenrichting for theft offenders, particularly at the Barelang City Police
Department (Polresta Barelang) in Batam. This study employs a descriptive method using a
normative approach (legal research) to obtain secondary data and an empirical approach (juridicalsociological) to gather primary data for field research. The results of this study indicate that the
prevention of eigenrichting by the Barelang City Police Department and its jurisdiction should
consistently implement policies established by the law, particularly those outlined in criminal
procedural law that prioritize human rights. This significantly influences the legal standing as
outlined in the Police Code of Ethics in carrying out their functions. In the field of investigation, they
have the ability to shoulder responsibility and ensure a high level of security within their jurisdiction.
For victims, the police provide security measures, including taking them to the hospital and
stabilizing the area. In cases of vigilantism, as a policy towards the perpetrators, the police conduct
investigations involving the recording or testimonies of witnesses, followed by gathering evidence.
These policies are established by the law and consistently prioritize human rights, as this greatly
influences the legal standing outlined in the police code of ethics in performing their duties. It is
recommended to carry out preventive and repressive actions in a more professional manner. The
community should be educated to refrain from taking matters into their own hands. Every assigned
task must be executed in accordance with legal procedures. Issuing orders, ensuring, and resolving
legal issues should be done competently and responsibly
