PENERAPAN ASAS NE NIS IN IDEM DAN ABSCUUR LIBEL DALAM GUGATAN PERDATA BERULANG (STUDI PUTUSAN PENGADILAN NEGERI KLATEN NOMOR 145/PDT.G/2021/PN KLN)

Abstrak

Gugatan perdata yang diajukan secara berulang terhadap objek dan pokok perkara yang sama merupakan permasalahan serius dalam praktik peradilan karena berpotensi menimbulkan ketidakpastian hukum serta pemborosan sumber daya peradilan. Putusan Pengadilan Negeri Klaten Nomor 145/Pdt.G/2021/PN Kln menjadi contoh konkret bagaimana pengadilan menerapkan asas ne bis in idem dan doktrin gugatan kabur (abscuur libel) dalam menghadapi gugatan yang diajukan berulang kali oleh penggugat. Tujuan : Penelitian ini bertujuan untuk menganalisis pertimbangan hukum majelis hakim dalam menyatakan gugatan tidak dapat diterima (niet ontvankelijk verklaard), serta menilai relevansinya terhadap asas kepastian hukum dalam hukum acara perdata. Metode : Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kasus, perundang-undangan, dan konseptual. Hasil : Hasil penelitian menunjukkan bahwa majelis hakim telah tepat menerapkan asas ne bis in idem karena perkara yang diajukan memiliki subjek, objek, dan pokok perkara yang sama dengan perkara sebelumnya yang telah berkekuatan hukum tetap. Selain itu, gugatan juga dinilai kabur karena tidak memenuhi syarat formil penyusunan gugatan dan adanya kekurangan pihak. Putusan ini menegaskan pentingnya kepatuhan terhadap asas-asas hukum acara perdata guna menjaga kepastian dan keadilan hukum.

Repeated civil lawsuits filed against the same object and subject matter are a serious problem in judicial practice because they have the potential to create legal uncertainty and waste judicial resources. The Klaten District Court Decision Number 145/Pdt.G/2021/PN Kln is a concrete example of how the court applies the principle of ne bis in idem and the doctrine of vague claims (abscuur libel) in dealing with lawsuits filed repeatedly by plaintiffs. Objective: This study aims to analyze the legal considerations of the panel of judges in declaring the lawsuit inadmissible (niet ontvankelijk verklaard), and assess its relevance to the principle of legal certainty in civil procedural law. Method: The research method used is normative legal research with a case, statutory, and conceptual approach. Results: The results of the study indicate that the panel of judges correctly applied the principle of ne bis in idem because the case submitted has the same subject, object, and subject matter as the previous case that has permanent legal force. In addition, the lawsuit is also considered vague because it does not meet the formal requirements for drafting a lawsuit and there is a lack of parties. This decision emphasizes the importance of compliance with the principles of civil procedural law in order to maintain legal certainty and justice.
