This study examines the legal protection of Notaries who are unaware of false statements made by appearers in the making of authentic deeds, viewed from the perspective of criminal law policy. This issue is significant given the position of the Notary as a public official responsible for the formal truth of a deed, rather than the material truth of the statements conveyed by the appearer, which creates a risk of erroneous criminalization of Notaries. This study aims to answer two problems: first, what form of legal protection is provided to Notaries who are unaware of false statements in the making of a deed; and second, what ideal concept of criminal law policy should provide legal protection to Notaries in this regard. This study employs a normative (doctrinal) legal research method with a prescriptive and applied nature, using the statute approach and conceptual approach, by examining relevant primary, secondary, and tertiary legal materials, including the Criminal Code (KUHP), the Notary Office Law, and the National Criminal Code. The results show that legal protection for Notaries is realized through preventive protection in the form of the regulation of authority and obligations under the Notary Office Law, as well as repressive protection in the form of limiting criminal liability only to Notaries who are proven to have known of or cooperated in the falsification. The recommended ideal concept of criminal law policy affirms that a Notary cannot be criminally liable as long as they have exercised their authority in accordance with procedure, were unaware of the falsification, and had no criminal intent, accompanied by the application of the ultimum remedium principle and the strengthening of the Notary Honorary Council's role as a filter prior to criminal proceedings.
